Legal notice

This Legal Notice sets out who operates this website, the basis on which its content is provided, and the intellectual property rights that attach to it.

It should be read together with our Terms of Service, Returns & Refunds Policy and Privacy Policy. Where a matter is dealt with more fully in one of those documents, that document governs.

We are not currently a registered VAT vendor. No Value Added Tax is charged on our prices.


2. Our relationship to the brands we sell

The Embroidery House is an independent authorised retailer. We are not Brother International, Brother South Africa, Empisal, or any other manufacturer or distributor, and we do not speak on their behalf.

Manufacturer warranties are given by the manufacturer, not by us, and are honoured through the relevant authorised service network. Our own obligations to you are set out in our Returns & Refunds Policy and arise under South African consumer law.

Nothing on this website should be read as a statement, representation or undertaking made by a manufacturer.


3. Accuracy of information

We take reasonable care to keep this website accurate and current. Even so:

  • Product specifications, features and included accessories are supplied by manufacturers and distributors and may change without notice. The manufacturer's current specification prevails over anything stated here.
  • Product images are illustrative. Colours vary between screens, and items shown in a photograph are not included unless expressly listed in the product description.
  • Prices and stock levels change. A price or availability shown here is not a guarantee, and listing a product is not a warranty that it is in stock. Pricing errors are dealt with in clause 6.3 of our Terms of Service.
  • Typographical and technical errors may occur. We correct them as soon as we become aware of them.

We give no warranty, express or implied, that the content of this website is complete, current or error-free. This does not affect your rights in respect of goods you actually purchase, which are governed by the Consumer Protection Act 68 of 2008 and our Returns & Refunds Policy.


4. Guidance is general, not professional advice

Buying guides, comparisons, tutorials, maintenance tips, project ideas and any advice we give by phone, WhatsApp or email are provided as general guidance only.

They are not a professional assessment of your circumstances and are not a warranty that a particular machine is fit for your specific project, materials, production volume or business model. Machine suitability depends on factors we cannot verify remotely.

Before relying on any guidance, satisfy yourself that a machine suits your intended use — and speak to us first. We are glad to help, and that conversation costs nothing.

Always follow the manufacturer's instruction manual. Where our guidance and the manufacturer's manual differ, follow the manual.


5. Safety

The machines we sell are electrically powered equipment with moving parts and needles. Operate them only in accordance with the manufacturer's instructions, using approved needles, parts, accessories and materials, and on a stable and appropriate power supply.

We are not liable for injury, damage or loss arising from misuse, unauthorised modification, servicing by anyone other than an authorised service agent, or use contrary to the manufacturer's instructions.


6. Website availability and security

We do not warrant that this website will be available without interruption, or that it will be free of viruses or other harmful components. Access may be affected by maintenance, hosting outages, connectivity failures, load-shedding and other matters outside our control.

You are responsible for your own device security and for maintaining your own anti-virus protection.


7. External links

This website may link to third-party websites, including manufacturer sites, our payment provider and social media platforms. Those sites are not under our control.

We provide links for convenience only. A link is not an endorsement, and we accept no responsibility for the content, accuracy, products, terms, privacy practices or availability of any third-party site. You visit them at your own risk and subject to their terms.


8. Limitation of liability

To the fullest extent permitted by South African law, and subject always to your rights under the Consumer Protection Act, we accept no liability for any loss or damage arising from your access to, use of, or reliance on this website or its content, including indirect or consequential loss.

We do not attempt to exclude liability for death or personal injury caused by our negligence, for fraud, for gross negligence, or for anything else that may not lawfully be excluded under Section 51 of the Consumer Protection Act.

All content on this website — including the name The Embroidery House, our logo, page copy, product descriptions we have written, layout, photography we have commissioned, illustrations, graphics, colour palette, typography treatment and overall design — is owned by or licensed to Nina Ventures (Pty) Ltd and is protected by the Copyright Act 98 of 1978, the Trade Marks Act 194 of 1993, and international law.

You may: view, download and print pages for your own personal, non-commercial reference.

You may not, without our prior written permission:

  • Copy, reproduce, republish, distribute, transmit or display any part of this website;
  • Reproduce our content, descriptions or images on another website, marketplace listing or social media account;
  • Use our name, logo or brand elements in any way likely to suggest an association, endorsement or partnership that does not exist;
  • Scrape, crawl, harvest, mine or systematically extract content, images, pricing or data from this website by any automated or manual means;
  • Use any content for commercial purposes or to train an automated system or model;

Brother, the Brother logo, Empisal, Scan N Cut, PE-Design, Artspira, and all model names, product names, product photography and associated marks are the property of their respective owners.

They appear on this website solely to identify and describe genuine product that we are authorised to sell, and to provide accurate information to customers. Their use does not imply that we own them, or that the trade mark owner endorses, sponsors or is affiliated with this website beyond our dealer relationship.

All rights in those marks remain with their owners.


11. Reporting an infringement

If you believe content on this website infringes your copyright, trade mark or other right, contact us at naeem@ninaventures.com with:

  • Identification of the right you hold and the basis on which you hold it;
  • The specific page or content complained of;
  • A statement of the grounds of complaint;
  • Confirmation that the complaint is made in good faith.

We investigate every complaint and act promptly where a complaint is well-founded. Complaints may also be made in the manner contemplated by Section 77 of ECTA.

This Legal Notice and your use of this website are governed by the laws of the Republic of South Africa. Disputes are dealt with as set out in clause 25 of our Terms of Service.
